1. Who we are

In these terms that is "we". "You" is the person who orders in the shop.

2. Scope

These terms apply to every contract for a DenDen access code that you conclude through the shop on www.denden-sec.com. Other terms apply only if we expressly agree to them.

3. What you get

DenDen is a messenger for a closed circle, usually a family. The only way in is with a code. Messages and voice calls are end-to-end encrypted.

• An access code adds 30 days (plan "Month") or 365 days (plan "Year") to your access to DenDen.
• You redeem the code when you register in the app, in the Android app under Settings > Access, or on the extend access page with your username.
• Codes stack. A new code extends from the end of your paid access, or from the moment you redeem it if no access is running. You can go up to 3 years ahead. A code that would reach further is not accepted and stays valid.
• A code that has not been redeemed is valid for 24 months after it was issued. Each code can be redeemed once.
• Invites from a family member are free. An account with unlimited access needs no code and cannot redeem one.

4. Ordering and conclusion of the contract

In the shop you choose the plan, the cryptocurrency and your country and tick the two statements about the right of withdrawal (section 8). Until then you can change everything. With the button "Order with obligation to pay" you make a binding offer, and the shop takes you to the NOWPayments payment page.

The contract is concluded as soon as your payment is confirmed. The shop then shows you your code. If an order is not paid and expires, no contract is formed.

The contract languages are German and English. You can open, save and print these terms on this page at any time.

5. Prices and payment

The prices shown in the shop when you order apply. All prices are final prices in euros.

You pay in cryptocurrency through the payment processor NOWPayments (FD Transfers LLC). The NOWPayments payment page shows how much you pay in the chosen cryptocurrency. If less arrives than the price, we issue no code; write to us with your order number and we will sort it out.

6. Delivery of the code

As soon as your payment is confirmed on the blockchain, the code appears in the shop in your browser. Depending on the cryptocurrency that takes from a minute to about an hour. We send no email.

Save the code straight away. We have no readable copy of it. The shop also shows a receipt with your order number and your two statements about the right of withdrawal; save or print it. If you can no longer open the code, write to us with your order number. We will then block it and issue a new one.

7. Duration, no automatic renewal

Your access ends when the paid period ends. There is no subscription: nothing renews by itself and we charge nothing automatically. You can delete your account in the app at any time.

8. Right of withdrawal

Your right. You may withdraw from this contract within 14 days without giving any reason. The period starts on the day the contract is concluded (section 4).

How to withdraw. Send us a clear statement, ideally by email to info@programmiert.at with your order number, or by post to the address in section 1. You may use the model withdrawal form below, but you do not have to. It is enough to send the statement before the period ends.

Immediate start. When ordering, you expressly request that we perform before the withdrawal period ends: the code is issued right after payment. You also confirm that you understand you lose your right of withdrawal once the contract has been fully performed, that is, when the access period ends. The shop takes no order without these two ticks.

What happens after a withdrawal. We refund your payment without undue delay and no later than 14 days after we receive your withdrawal. Because you requested the immediate start, you pay for the time up to your withdrawal an amount that is in proportion to the total price for what was provided until then; we deduct it from the refund, and your access is shortened accordingly. If you have not redeemed the code yet, we refund the full price and block the code.

How we refund. In the cryptocurrency you paid with, to an address you give us, or as the equivalent in euros if we agree on that with you. We charge you no fees for the refund.

9. Model withdrawal form

If you want to withdraw from the contract, you can fill in this form and send it to us. It helps if you add the order number from the shop.

10. Availability

We run DenDen with care, but we cannot promise that the service is always reachable without interruption. Maintenance, updates and faults on our side or at our providers can interrupt it for a while. We keep maintenance as short as we can.

11. Fair use

• Do not use DenDen for illegal content, to harass or threaten others, or to attack or overload the service.
• Keep your password and your Key Card secret. We never ask for them.
• Your messages are end-to-end encrypted. We cannot read them and therefore do not check them. If we learn of abuse, we may block the account concerned.

12. Warranty and liability

The statutory warranty applies.

We are liable under the statutory provisions. We are fully liable for damage we cause intentionally or through gross negligence and for personal injury. We are not liable for other damage caused through slight negligence, as far as the law allows.

13. Privacy

Which data we process, where it is kept and for how long is set out in the privacy policy.

14. Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you have your habitual residence.

For claims against you as a consumer, the statutory places of jurisdiction apply. If your domicile, habitual residence or place of work is in Austria, the court there has jurisdiction.
